TERMS AND CONDITIONS
FOR MEMBERS
By becoming a member of Llapanchik Hampinakuy LLC you acknowledge and agree to the following terms and conditions:
Assumption of Risk:
Participation as a member of Llapanchik Hampinakuy LLC’s directory involves inherent risks of harm. Members voluntarily assume all risks pertaining to interactions with those looking for healers/users. Llapanchik Hampinakuy LLC has a vetting process in place to ensure overall ethical qualifications, however, as a member you are responsible for ethical care to your clients.
Release of Liability:
To the fullest extent permitted by law, members release Llapanchik Hampinakuy LLC, its officers, directors, employees, and agents from any and all liability for injuries, damages, or losses that may occur during or as a result of membership, activities, events, or facility use. In no event shall Llapanchik Hampinakuy LLC be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from member’s participation in Llapanchik Hampinakuy LLC or the use of the use or inability to use Llapanchik Hampinakuy LLC’s directory or any of its platforms or services.
Members of Llapanchik Hampinakuy LLC’s directory platform are solely responsible for the accuracy and legality of the information provided in their listings. Llapanchik Hampinakuy LLC shall not be liable for any damages, including but not limited to, direct, indirect, incidental, consequential, or punitive damages, arising out of any inaccuracies or misrepresentations in member listings.
Members acknowledge and agree that Llapanchik Hampinakuy LLC shall not be liable for any damages, losses, or liabilities arising from their actions, omissions, or representations, including but not limited to claims brought by users or third parties. Members are solely responsible for their conduct and interactions with users and other members of the platform.
Indemnification:
Members of Llapanchik Hampinakuy LLC’s directory platform agree to indemnify and hold harmless Llapanchik Hampinakuy LLC from any claims, liabilities, damages, or expenses (including attorney fees) arising out of or related to the content of their listings, the services they provide, or any breach of these terms and conditions.
Compliance with Rules and Regulations:
Members agree to comply with all rules, regulations, and policies set forth by Llapanchik Hampinakuy LLC. Failure to adhere to these guidelines may result in the termination of membership.
Ethical Practices of Confidentiality:
Members acknowledge that they will maintain identifying, personal and/or medical information confidential and will safeguard this information from all third parties.
Content Moderation and Removal:
Llapanchik Hampinakuy LLC reserves the right to monitor, review, and remove any member listings or content that violates these terms and conditions, is unlawful, offensive, harmful, or otherwise objectionable. Llapanchik Hampinakuy LLC shall have sole discretion in determining the appropriateness of member listings and content and may take action, including suspension or termination of membership, for violations.
Member Representations and Warranties:
By listing their services on Llapanchik Hampinakuy LLC’s directory platform, members represent and warrant that the information provided in their listings is accurate, truthful, and not misleading. Members further represent and warrant that they have the legal right and authority to offer the services described in their listings and that the provision of such services complies with all applicable laws and regulations.
Disclosure of Unlicensed Status:
Members who are unlicensed practitioners acknowledge and agree to disclose their unlicensed status prominently in their listings on Llapanchik Hampinakuy LLC’s directory. Users are hereby advised to exercise caution when engaging with unlicensed practitioners and are encouraged to independently verify the qualifications and legality of services offered by such members.
No Endorsement of Unlicensed Practitioners:
The inclusion of unlicensed practitioners on Llapanchik Hampinakuy LLC’s platform does not constitute an endorsement, recommendation, or guarantee of their services by Llapanchik Hampinakuy LLC. Users acknowledge that Llapanchik Hampinakuy LLC does not verify the qualifications or legality of services offered by unlicensed practitioners and are encouraged to exercise caution when engaging with such members.
Termination of Membership:
Llapanchik Hampinakuy LLC reserves the right to suspend or terminate a member’s access to the directory platform at any time and for any reason, including but not limited to violations of these terms and conditions, unlawful conduct, or misuse of the platform. Llapanchik Hampinakuy LLC shall have sole discretion in determining whether to suspend or terminate a member’s access and may do so without prior notice.
Photography:
Llapanchik Hampinakuy LLC reserves the right to use photographs or recordings of members for promotional purposes. Members who do not wish to be featured should notify Llapanchik Hampinakuy LLC in writing.
Changes to Terms:
Llapanchik Hampinakuy LLC reserves the right to modify, update, or amend these terms and conditions. Members will be notified of any changes.

Disclaimer of Endorsement:
The inclusion of healers in Llapanchik Hampinakuy LLC’s directory platform does not constitute an endorsement, recommendation, or guarantee of their services by Llapanchik Hampinakuy LLCs. Users are encouraged to independently verify the qualifications and credentials of therapists listed in the directory before engaging their services.
No Liability for Services Rendered:
Users of Llapanchik Hampinakuy LLCs directory platform understand and acknowledge that Llapanchik Hampinakuy LLC does not provide or endorse any services listed on the platform. Llapanchik Hampinakuy LLC shall not be liable for any damages resulting from the services rendered by healers listed in the directory. Users acknowledge that their interactions and engagements with therapists listed on the platform are at their own risk.
By using Llapanchik Hampinakuy LLC’s directory platform, users hereby release, waive, and discharge Llapanchik Hampinakuy LLCs , its officers, directors, employees, agents, and affiliates from any and all claims, liabilities, damages, losses, or expenses arising out of or in any way related to the use of the platform or the services provided by therapists listed therein, including but not limited to claims for personal injury, property damage, or economic loss.
No Duty to Screen Members:
While Llapanchik Hampinakuy LLCs may undertake reasonable efforts to verify the identity and qualifications of therapists listed in the directory, Llapanchik Hampinakuy LLCs does not guarantee the accuracy or completeness of such information. Llapanchik Hampinakuy LLCs shall not be liable for any damages resulting from the actions or omissions of therapists listed in the directory.
Assumption of Risk by Users:
Users of Llapanchik Hampinakuy LLC’s directory platform acknowledge and agree that the use of therapist services listed therein is at their own risk. Llapanchik Hampinakuy LLCs shall not be liable for any damages, losses, or injuries arising from the use of or reliance on information obtained through the directory.
Users of Llapanchik Hampinakuy LLC’s directory platform acknowledge that Llapanchik Hampinakuy LLC acts solely as a facilitator for connecting users with healers listed in the directory.
Disclaimer Regarding Healers Working and/or Living Outside of the United States:
Users acknowledge and understand that Llapanchik Hampinakuy LLC may not be able to verify the qualifications, credentials, or legality of healers residing outside of the United States. Users who choose to engage with healers residing abroad do so at their own risk. Llapanchik Hampinakuy LLC disclaims any responsibility or liability for the actions, omissions, or qualifications of healers residing outside of the United States.
User Acknowledgment of Risks for Working with Member Abroad:
Users acknowledge and agree that engaging with healers residing abroad may pose additional risks, including but not limited to differences in regulatory frameworks, cultural practices, and language barriers. Users are solely responsible for assessing and mitigating these risks, and Llapanchik Hampinakuy LLC shall not be liable for any damages, losses, or liabilities arising from engagements with healers residing abroad.
Limitation of Liability for International Transactions:
In no event shall Llapanchik Hampinakuy LLC be liable for any damages, losses, or liabilities arising from transactions or interactions involving healers residing outside of the United States including but not limited to disputes over services, payment issues, or quality of care. Users engaging with healers residing abroad do so at their own risk and agree to release Llapanchik Hampinakuy LLC from any and all claims related thereto.
No Duty to Guarantee Credentials:
While Llapanchik Hampinakuy LLC will undertake reasonable efforts to verify the qualifications and credentials of healers listed on the platform, Llapanchik Hampinakuy LLC does not guarantee the accuracy, reliability, or legality of credentials obtained from foreign jurisdictions. Llapanchik Hampinakuy LLC does not verify the licensing status of international members or the legality of services offered by unlicensed practitioners. Llapanchik Hampinakuy LLC shall not be liable for any damages, losses, or liabilities arising from engagements with unlicensed practitioners. Llapanchik Hampinakuy LLC shall not be liable for any damages, losses, or liabilities arising from the actions, omissions, or representations of any healer, including those residing abroad or unlicensed healers.
Indemnification for International Engagements:
Users engaging with healers residing abroad agree to indemnify, defend, and hold harmless Llapanchik Hampinakuy LLC its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, or expenses (including attorney fees) arising out of or in any way related to engagements with such healers, including but not limited to claims for malpractice, negligence, or breach of contract.
Release of Liability for International Engagements:
By engaging with healers residing abroad, users hereby release, waive, and discharge Llapanchik Hampinakuy LLC, its officers, directors, employees, agents, and affiliates from any and all claims, liabilities, damages, losses, or expenses arising from such engagements, including but not limited to claims for personal injury, property damage, or economic loss.
User Acknowledgment of Risks with Unlicensed Practitioners:
Users acknowledge and understand that engaging with unlicensed practitioners may pose additional risks, including but not limited to variations in regulatory standards, qualifications, and oversight mechanisms. Users are solely responsible for assessing these risks and agree to release Llapanchik Hampinakuy LLC from any and all liability arising from engagements with unlicensed practitioners.
Limitation of Liability for Engagements with Unlicensed Practitioners:
In no event shall Llapanchik Hampinakuy LLC be liable for any damages, losses, or liabilities arising from engagements with unlicensed practitioners listed on the platform, including but not limited to claims for malpractice, negligence, or breach of contract. Users engaging with unlicensed practitioners do so at their own risk and agree to release Llapanchik Hampinakuy LLC from any and all claims related thereto.
Indemnification for Engagements with Unlicensed Practitioners:
Users engaging with unlicensed practitioners listed on the platform agree to indemnify, defend, and hold harmless Llapanchik Hampinakuy LLC its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, or expenses (including attorney fees) arising out of or in any way related to such engagements.
FOR ALL
Venue for Lawsuits:
Any legal action or proceeding arising out of or relating to these terms and conditions or the use of Llapanchik Hampinakuy LLC’s directory platform shall be brought exclusively in the state or federal courts located in Raleigh, North Carolina. Each party hereby submits to the personal jurisdiction of such courts and waives any objections thereto.
Mandatory Mediation and Arbitration:
In the event of any dispute or claim arising out of or relating to these terms and conditions or the use of Llapanchik Hampinakuy LLC’s directory platform, the parties agree to first attempt to resolve the dispute through good-faith mediation conducted in Raleigh, North Carolina. If the dispute cannot be resolved through mediation within 60 days, the parties agree to submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Raleigh, North Carolina, and the decision of the arbitrator(s) shall be final and binding on the parties. Each party shall bear its own costs associated with the mediation and arbitration proceedings.
Waiver of Class Action and Jury Trial:
Any dispute resolution proceedings, whether mediation or arbitration, shall be conducted solely on an individual basis and not as a class, consolidated, or representative action. The parties hereby waive any right to participate in a class action lawsuit or class-wide arbitration. Furthermore, the parties waive any right to a jury trial in connection with any dispute or claim arising out of or relating to these terms and conditions or the use of Llapanchik Hampinakuy LLC’s directory platform.
Severability:
If any provision of these terms and conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall nevertheless continue in full force and effect, and the unenforceable provision shall be construed to the maximum extent possible to achieve the original intentions of the parties.
